Terms and Conditions for Scripters

Welcome to Scripters!

These Terms of Service ("Terms") constitute a legally binding agreement between you and Scripters ("we," "us," or "our") governing your access to and use of the Scripters platform at https://scripters.top (the "Service"). By creating an account or using our Service, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use Scripters.

1. Description of Service

Scripters is a developer portfolio and metrics hub that enables software developers to:
- Create public portfolio pages showcasing their GitHub and LeetCode statistics
- Automatically sync and display coding metrics, repository information, and problem-solving progress
- Customize portfolio layouts with drag-and-drop blocks and 28 professional themes
- Track visitor analytics and engagement on their portfolios
- Access AI-powered insights and career growth recommendations (with Pro tier)
- Generate AI-enhanced resumes and export them as PDFs (with Pro tier)
- Connect custom domains to their portfolios (with Pro tier)

2. Account Registration and Eligibility

2.1 Account Creation
To use Scripters, you must:
- Sign in using GitHub OAuth authentication
- Be at least 13 years of age (or the age of majority in your jurisdiction)
- Provide accurate and complete information
- Maintain the security of your account credentials

2.2 Account Responsibility
You are solely responsible for:
- All activity that occurs under your account
- Maintaining the confidentiality of your GitHub authentication
- Notifying us immediately of any unauthorized access or security breaches
- Ensuring your profile content complies with these Terms

2.3 One Account Per User
Each user may maintain only one active Scripters account. Creating multiple accounts for fraudulent purposes is prohibited and may result in termination.

3. Service Tiers

3.1 Free Tier
The Free tier includes:
- Public portfolio page at scripters.top/[username]
- Automatic GitHub and LeetCode stats synchronization (nightly updates)
- Customizable themes and drag-and-drop layout editor
- 28 professional themes
- Basic visitor analytics (30-day retention)
- Social links and bio customization

3.2 Pro Tier
Scripters Pro is a one-time lifetime purchase that includes all Free features plus:
- Custom domain support with SSL certificates (CNAME configuration)
- AI-powered resume generator with PDF export
- Advanced analytics dashboard with 90-day data retention and CSV export
- Interactive AI chatbot widget for portfolio visitors
- Weekly AI-generated profile insights and growth coaching emails
- Priority customer support
- Early access to new features

3.3 Pro Purchase Terms
- Pro tier is purchased once for lifetime access
- Pricing is displayed on our website and may change for new purchases
- Existing Pro users are grandfathered into their original purchase price
- Pro status is tied to your account and non-transferable
- We reserve the right to modify Pro features but will maintain core functionality

4. User Content and Conduct

4.1 Your Profile Content
You retain ownership of all content you provide to Scripters, including:
- Profile information (bio, tagline, display name, social links)
- Custom domain configurations
- Block layout and theme preferences

4.2 Content License to Scripters
By using our Service, you grant Scripters a worldwide, non-exclusive, royalty-free license to:
- Display your profile content on scripters.top/[username]
- Cache and optimize your GitHub and LeetCode data for performance
- Generate AI insights based on your coding activity
- Include anonymized usage data in aggregate statistics for marketing purposes

4.3 Prohibited Uses
You agree NOT to:
- Violate any laws, regulations, or third-party rights
- Impersonate others or provide false information
- Harass, threaten, or abuse other users or Scripters staff
- Upload malicious code, viruses, or scripts that interfere with the Service
- Scrape, data mine, or use automated tools to access other users' profiles en masse
- Attempt to reverse engineer, decompile, or hack the Scripters platform
- Use the Service to promote spam, phishing, or fraudulent schemes
- Display offensive, defamatory, or illegal content on your public profile
- Resell, redistribute, or sublicense access to Scripters

Violation of these terms may result in immediate account suspension or termination without refund.

5. Third-Party Services and Data

5.1 GitHub Integration
By connecting your GitHub account:
- You authorize Scripters to access your public GitHub profile and repository data
- You acknowledge that GitHub data is fetched via GitHub's API and subject to GitHub's Terms of Service
- Scripters is not responsible for changes to GitHub's API or data availability

5.2 LeetCode Integration
By connecting your LeetCode account:
- You provide your LeetCode username for public data retrieval
- LeetCode stats are fetched from publicly available LeetCode profiles
- Scripters is not affiliated with LeetCode and is not responsible for LeetCode data accuracy

5.3 OpenAI Integration
For AI-powered features (Pro users):
- Your coding data (repository names, languages, LeetCode stats) is sent to OpenAI for analysis
- OpenAI does not store your data beyond generating responses
- AI-generated insights are provided "as-is" without guarantees of accuracy

6. Payment and Billing

6.1 Payment Processing
All payments are processed securely through Stripe, our third-party payment processor. By making a purchase:
- You agree to Stripe's Terms of Service
- You authorize Scripters to charge your payment method for the Pro tier purchase
- We do not store your credit card information on our servers

6.2 Pricing
- Pro tier pricing is displayed on our website at the time of purchase
- All prices are in USD unless otherwise specified
- Prices may be updated at any time, but existing Pro users are not affected

6.3 Taxes
You are responsible for any applicable taxes (sales tax, VAT, GST, etc.) based on your jurisdiction. Taxes may be added at checkout where required by law.

7. Refund Policy

7.1 14-Day Money-Back Guarantee
We offer a full refund for Scripters Pro purchases within 14 days of the transaction date if:
- You have not abused the Service or violated these Terms
- You contact us at support@scripters.top with your refund request
- You provide a valid reason for dissatisfaction

7.2 Refund Process
- Refunds are processed within 5-7 business days after approval
- Refunds are issued to the original payment method via Stripe
- Pro features are immediately revoked upon refund approval
- We reserve the right to deny refunds for fraudulent or abusive behavior

7.3 No Refunds After 14 Days
After the 14-day period, all Pro purchases are final. No refunds will be issued except as required by law or at our sole discretion.

8. Intellectual Property

8.1 Scripters Ownership
Scripters and all associated branding, design, code, logos, and content are the exclusive property of Scripters and protected by copyright, trademark, and other intellectual property laws. You may not:
- Copy, modify, or reverse engineer the Scripters platform
- Use our branding or logos without written permission
- Create derivative works based on our Service

8.2 User Data Ownership
You retain all rights to your profile content and data. However:
- GitHub and LeetCode data remains the property of their respective platforms
- Aggregated and anonymized usage statistics may be used by Scripters for analytics and marketing

9. Data and Privacy

Your use of Scripters is also governed by our Privacy Policy, available at https://scripters.top/privacy-policy. By using our Service, you consent to our collection, use, and storage of your data as described in the Privacy Policy.

Key privacy principles:
- We do not sell your personal data to third parties
- You can export or delete your data at any time from your dashboard
- GitHub and LeetCode data is fetched via official APIs and refreshed nightly
- Visitor analytics are collected on your public profile to provide engagement insights

10. Service Availability and Modifications

10.1 Service Uptime
We strive to maintain 99.9% uptime for Scripters, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:
- Scheduled maintenance (announced in advance when possible)
- Technical issues or server outages
- Third-party service disruptions (GitHub API, MongoDB, Vercel, etc.)

10.2 Modifications to the Service
We reserve the right to:
- Add, modify, or remove features at any time
- Update the user interface and design
- Change API integrations or data sources
- Discontinue the Service with 30 days' notice (Pro users will receive prorated refunds if discontinuation occurs within 2 years of purchase)

11. Termination

11.1 Termination by You
You may terminate your account at any time by:
- Deleting your account from your dashboard settings
- Emailing us at support@scripters.top

Upon termination:
- Your public profile will be immediately removed
- Your data will be deleted within 30 days (except as required for legal compliance)
- No refunds will be issued for Pro tier purchases beyond the 14-day refund period

11.2 Termination by Scripters
We may suspend or terminate your account immediately if:
- You violate these Terms of Service
- You engage in fraudulent, abusive, or illegal activity
- You repeatedly upload harmful or offensive content
- Your account is inactive for more than 2 years (with 30-day notice)

Termination for cause does not entitle you to a refund.

12. Disclaimers and Limitation of Liability

12.1 Service Provided "As-Is"
SCRIPTERS IS PROVIDED "AS-IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Accuracy or completeness of GitHub or LeetCode data
- Availability or reliability of the Service
- Accuracy of AI-generated insights or resumes

12.2 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SCRIPTERS SHALL NOT BE LIABLE FOR:
- Indirect, incidental, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Errors or inaccuracies in third-party data (GitHub, LeetCode)
- Service interruptions or data loss
- Unauthorized access to your account due to your negligence

IN NO EVENT SHALL SCRIPTERS' TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR PRO TIER IN THE PAST 12 MONTHS (OR $100 IF YOU ARE A FREE USER).

12.3 Third-Party Services
Scripters integrates with third-party services (GitHub, Stripe, OpenAI, etc.). We are not responsible for:
- Downtime or changes to third-party APIs
- Data accuracy from external sources
- Third-party terms of service or privacy policies

13. Indemnification

You agree to indemnify, defend, and hold harmless Scripters, its officers, employees, and partners from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your infringement of any third-party rights
- Content you upload or display on your profile

14. Governing Law and Dispute Resolution

14.1 Governing Law
These Terms are governed by the laws of France, without regard to conflict of law principles.

14.2 Dispute Resolution
Any disputes arising from these Terms or your use of Scripters shall be resolved through:
- Good-faith negotiation between the parties
- Binding arbitration in France (if negotiation fails)
- Small claims court in your jurisdiction (for claims under applicable thresholds)

14.3 Class Action Waiver
You agree to resolve disputes individually and waive any right to participate in class-action lawsuits or class-wide arbitration.

15. General Provisions

15.1 Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and Scripters and supersede any prior agreements.

15.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15.3 No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.

15.4 Assignment
You may not assign or transfer these Terms without our written consent. We may assign these Terms to any successor or affiliate without restriction.

16. Updates to These Terms

We may update these Terms from time to time to reflect:
- Changes to our Service or features
- Legal or regulatory requirements
- Clarifications or improvements to language

When we update these Terms:
- The "Last Updated" date will be revised
- Material changes will be communicated via email to registered users
- Continued use of Scripters after changes constitutes acceptance of the updated Terms
- If you do not agree to updated Terms, you must stop using the Service
